Use of the Service and the Data

Subject to the terms of this Agreement, SHoF grants to you a limited, non-exclusive, non-transferable right to use the Service and the data made available as part of, or in connection with, the Service (the "Data") for academical research projects during the term of this Agreement. You shall not use the Service or the Data for any other purpose whatsoever. You may publish, share, and distribute research analysis and aggregate statistics derived from the Service and the Data. Except as otherwise expressly set forth herein,You shall not, directly or indirectly, license, sell, rent, lease, transfer, disclose, reproduce, distribute, forward or otherwise make available the Service or the Data, or any part thereof, to any third party.

For all intents and purposes, SHoF and its licensors have and shall retain, all title, exclusive ownership rights and all intellectual property rights and other rights and interests in the Service and the Data. You acknowledge that the Service and the Data have been prepared, selected, coordinated and arranged through the expenditure of substantial time, judgment and money and constitutes valuable property of SHoF and its licensors. You acknowledge that your use of the Service or Data in violation of this Agreement may result in third party claims against SHoF and you agree to indemnify and hold SHoF harmless from any costs, expenses, damages and/or losses resulting from such third party claim.

All academical reports, papers and other publications which have been prepared based on or by use of the Data shall be sent to SHoF at datareport@houseoffinance.se immediately after such works have been published or otherwise made public. You grant to SHoF the right to use, distribute and make available on its web sites all such reports, papers and other publications free of charge and without restrictions. In all academical reports, papers and other publications which have been prepared based on or by use of the Data, you shall include a reference to SHoF and the name of the relevant database in accordance with SHoF’s guidelines for such references.

Security

You agree to keep login details to your user account secure and not disclose such login details to any third party. You accept full responsibility for all activities on your user account undertaken with your login details. You shall not circumvent, deactivate or otherwise interfere with any technological measure or security related feature of the Service. You shall notify SHoF immediately of any unauthorized use of your login details or any other known or suspected breach of security. You are responsible for the equipment, software and network connectivity required for your access and use of the Service and the Data.

Term

This Agreement takes effect immediately upon completion of the registration process and remains in effect until terminated by you or SHoF by providing 30 days prior notice. SHoF shall be entitled to with immediate effect and without liability terminate this Agreement or disable your access to the Service and the Data if you breach or otherwise fail to comply with this Agreement. In case of such termination, you shall delete all Data in your possession.

Privacy

During the registration process, you may need to provide certain user data to SHoF, including but not limited to user names, e-mail addresses and contact details. In order to be able to use the Service, you must also allow SHoF to store and retrieve session information on your devices, through the use of cookies and other tracking software. SHoF will use the information to administer and provide the Service and the Data and to ensure that unauthorised persons do not gain access to the Service or the Data. SHoF may also use the information to improve the Service and for analytical and statistical purposes. By accepting this Agreement, you consent to the collection and processing of personal data by SHoF as described above. Upon request, you have the right to access the personal data related to your user account and request rectification of such data.

We use the following SWAMID attributes:

• eduPersonPrincipalName: the internal identificator given to user by organization
• mail: the email address of the user
• affiliation: the role of the user in his/her organization
• displayName: name and surname of the user
• organizationName: the name of the organization
• norEduOrgAcronym: an acronym that uniquely identify the user organization

We use but do not store the following SWAMID attributes for authorization purposes and to deliver query result to the users:

• eduPersonPrincipalName
• mail
• affiliation
• displayName
• norEduOrgAcronym

We use and store the following SWAMID attributes for anonymous internal analytics and reports:

• organizationName
• affiliation
• norEduOrgAcronym

As a SWAMID Service Provider, SHoF adheres to the GÉANT Data Protection Code of Conduct

Fees

You shall pay for use of the Service and the Data in accordance with the fees, charges and billing terms applied by SHoF from time to time.

Disclaimer

You acknowledge and agree that the Service and the Data are provided on an "as is" basis without any warranty of any kind and that the entire risk as to the use of the Service and the Data shall be borne by you. SHoF does not guarantee or warrant the correctness, completeness, reliability or availability of the Service and the Data and, to the maximum extent permitted by applicable law, expressly disclaims any implied warranty of any kind, including non-infringement or fitness for a particular purpose of the Service and the Data. In no event shall SHoF be liable for any direct, indirect or consequential loss or damage, including but not limited to, any loss of profits, loss of data, loss of revenue or any third party claims. Nothing herein shall be construed as excluding or limiting SHoF’s liability for fraud, wilful misconduct or any liability which cannot be excluded or limited under applicable law.

Amendments

SHoF reserves the right to change, modify or alter the Service and the Data at any time and without notice, such as by adding or removing features or discontinuing the provision of the Service and the Data or parts thereof. SHoF reserves the right to change, modify or alter this Agreement at any time. You will be informed of such alterations of this Agreement by e-mail or by postings in the Service. Continued use of the Service or the Data after any such changes shall constitute acceptance by you of the revised Agreement.

Miscellaneous

This Agreement represent the entire agreement between you and SHoF relating to the subject matter hereof, and supersedes all prior understandings and agreements relating to such subject matter, whether oral or written. If any provision of this Agreement is held to be invalid, void or for any reason unenforceable, such provision shall be adjusted and shall not affect the validity and enforceability of the remaining provisions.

Applicable law and disputes

This Agreement shall be governed by and construed in accordance with the laws of Sweden. Any dispute, controversy or claim arising out of or in connection with this Agreement shall be settled by a Swedish court of general jurisdiction and the Stockholm District Court shall be the court of first instance.

Villkor

Användning av Tjänsten och Datan

I enlighet med villkoren i detta avtal ger SHoF dig en begränsad, icke-exklusiv, icke-överlåtbar rätt att använda Tjänsten och de data som görs tillgängliga som en del av, eller i samband med, Tjänsten ("Datan") för akademiska forskningsprojekt under detta avtals löptid. Du får inte använda Tjänsten eller Datan för något annat syfte. Du får publicera, dela och distribuera forskningsanalys och aggregerad statistik som härrör från Tjänsten och Datan. Om inte annat uttryckligen anges häri får du inte, direkt eller indirekt, licensiera, sälja, hyra ut, leasa, överföra, avslöja, reproducera, distribuera, vidarebefordra eller på annat sätt göra Tjänsten eller Datan eller någon del därav tillgänglig för någon tredje part.

SHoF och dess licensgivare har och ska behålla all äganderätt, exklusiva äganderätter och alla immateriella rättigheter och andra rättigheter och intressen i Tjänsten och Datan. Du förstår att Tjänsten och Data har förberetts, valts ut, samordnats och arrangerats genom utgifter i termer av betydande tid, omdöme och pengar och utgör värdefull egendom för SHoF och dess licensgivare. Du är medveten om att din användning av Tjänsten eller Datan i strid med detta avtal kan leda till anspråk från tredje part mot SHoF och du samtycker till att hålla SHoF skadeslös från alla kostnader, utgifter, skador och/eller förluster som härrör från ett sådant tredje parts anspråk.

Alla akademiska rapporter, uppsatser och andra publikationer som har utarbetats med utgångspunkt i eller med användning av Datan ska skickas till SHoF på datareport@houseoffinance.se omedelbart efter att sådana verk har publicerats eller på annat sätt offentliggjorts. Du ger SHoF rätten att använda, distribuera och tillgängliggöra alla sådana rapporter, tidningar och andra publikationer på sina webbplatser utan kostnad och utan begränsningar. I alla akademiska rapporter, uppsatser och andra publikationer som har utarbetats baserat på eller genom användning av Datan ska du inkludera en hänvisning till SHoF och namnet på relevant databas i enlighet med SHoFs riktlinjer för sådana referenser.

Säkerhet

Du samtycker till att hålla inloggningsuppgifterna till ditt användarkonto säkra och inte avslöja sådana inloggningsuppgifter till någon tredje part. Du tar fullt ansvar för alla aktiviteter på ditt användarkonto som utförs med dina inloggningsuppgifter. Du får inte kringgå, inaktivera eller på annat sätt störa någon teknisk åtgärd eller säkerhetsrelaterad funktion i Tjänsten. Du ska omedelbart meddela SHoF om all obehörig användning av dina inloggningsuppgifter eller andra kända eller misstänkta säkerhetsbrott. Du ansvarar för den utrustning, programvara och nätverksanslutning som krävs för din åtkomst och användning av Tjänsten och Datan.

Tidsperiod

Detta avtal träder i kraft omedelbart efter slutförandet av registreringsprocessen och förblir i kraft tills det sägs upp av dig eller SHoF med 30 dagars varsel. SHoF har rätt att med omedelbar verkan och utan ansvar säga upp detta avtal eller inaktivera din åtkomst till Tjänsten och Datan om du bryter mot eller på annat sätt inte följer detta avtal. I händelse av en sådan uppsägning ska du radera all data i din besittning.

Integritet

Under registreringsprocessen kan du behöva tillhandahålla viss användardata till SHoF, inklusive men inte begränsat till användarnamn, e-postadresser och kontaktuppgifter. För att kunna använda Tjänsten måste du även tillåta SHoF att lagra och hämta sessionsinformation på dina enheter, genom användning av cookies och annan spårningsprogramvara. SHoF kommer att använda informationen för att administrera och tillhandahålla Tjänsten och Datan och för att säkerställa att obehöriga personer inte får tillgång till Tjänsten eller Datan. SHoF kan också använda informationen för att förbättra Tjänsten och för analytiska och statistiska ändamål. Genom att acceptera detta avtal samtycker du till insamling och behandling av personuppgifter av SHoF enligt beskrivningen ovan. På förfrågan, har du rätt till tillgång av den personlig data som är relaterad till ditt användarkonto och begära rättelse av sådan data.

Vi använder följande SWAMID-attribut:

• eduPersonPrincipalName: den interna identifieraren som ges till användaren av organisationen
• mail: användarens e-postadress
• affiliation: användarens roll i sin organisation
• displayName: användarens namn och efternamn
• organizationName: organisationens namn
• norEduOrgAcronym: en akronym som unikt identifierar användarens organisation

Vi använder men sparar inte följande SWAMID-attribut för auktoriseringsändamål och för att leverera frågeresultat till användarna:

• eduPersonPrincipalName
• mail
• affiliation
• displayName
• norEduOrgAcronym

Vi använder och sparar följande SWAMID-attribut för anonym intern analys och rapporter:

• organizationName
• affiliation
• norEduOrgAcronym

Avgifter

Du ska betala för användningen av Tjänsten och Datan i enlighet med de avgifter och faktureringsvillkor som tillämpas av SHoF från tid till annan.

Ansvarsfriskrivning

Du förstår och samtycker till att Tjänsten och Datan tillhandahålls "i befintligt skick" utan någon garanti av något slag och att hela risken för användningen av Tjänsten och Datan ska bäras av dig. SHoF garanterar eller försäkrar inte riktigheten, fullständigheten, tillförlitligheten eller tillgängligheten av Tjänsten och Datan och, i den maximala utsträckning som tillåts enligt tillämplig lag, frånsäger sig uttryckligen alla underförstådda garantier av något slag, inklusive icke-intrång eller lämplighet för ett visst ändamål av Tjänsten och Datan. SHoF ska under inga omständigheter hållas ansvarigt för någon direkt, indirekt eller följdförlust eller skada, inklusive men inte begränsat till, förlust av vinst, förlust av data, förlust av intäkter eller tredje parts anspråk. Ingenting häri ska tolkas som att det utesluter eller begränsar SHoF:s ansvar för bedrägeri, uppsåtligt fel eller något ansvar som inte kan uteslutas eller begränsas enligt tillämplig lag.

Tillägg

SHoF förbehåller sig rätten att ändra, modifiera eller ändra Tjänsten och Datan när som helst och utan föregående meddelande, till exempel genom att lägga till eller ta bort funktioner eller avbryta tillhandahållandet av Tjänsten och Datan eller delar därav. SHoF förbehåller sig rätten att ändra, modifiera eller ändra detta avtal när som helst. Du kommer att informeras om sådana ändringar av detta avtal via e-post eller genom inlägg i Tjänsten. Fortsatt användning av Tjänsten eller Datan efter sådana ändringar ska innebära att du accepterar det reviderade avtalet.

Diverse

Detta avtal representerar hela avtalet mellan dig och SHoF avseende ämnet häri, och ersätter alla tidigare överenskommelser och avtal som hänför sig till sådant ämne, vare sig det är muntligt eller skriftligt. Om någon bestämmelse i detta avtal anses vara ogiltig, betydelselös eller av någon anledning omöjlig att verkställa, ska denna bestämmelse justeras och ska inte påverka giltigheten och verkställbarheten av de återstående bestämmelserna.

Tillämplig lag och tvister

Detta avtal ska styras av och tolkas i enlighet med svensk lag. Varje tvist, kontrovers eller anspråk som uppstår ur eller i samband med detta Avtal ska avgöras av svensk domstol med allmän behörighet och Stockholms tingsrätt ska vara första instans.
